These Terms of Service (“Terms”) govern access to the websites, mobile applications, and related services offered under the names StudentHub, Agovia, and Chacha Markets (collectively, the “Services”).
The Services are operated by Agovia Edusphere Ventures LLC, based in Ghana, with support for United States operations provided by Agyeah Motors LLC (together, “we,” “us,” or “our”). The entity responsible for a particular transaction may be identified at checkout, in an order confirmation, or in additional service-specific terms.
By creating an account or using a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and accounts
StudentHub and Agovia are intended for users aged 13 or older. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use. A minor may not independently enter a paid transaction, offer regulated services, or act where applicable law requires an adult.
Chacha Markets is intended only for users aged 18 or older.
You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account except to the extent caused by our failure to use reasonable safeguards.
2. StudentHub
StudentHub provides tools for campus-community listings, barter proposals, marketplace transactions, courier coordination, ratings, and related educational or student services.
StudentHub is generally a platform connecting users. Unless expressly stated otherwise, we are not the buyer, seller, courier, employer, school, or owner of user-posted items. Users are responsible for:
- accurately describing listings and their condition;
- having the legal right to offer an item or service;
- complying with campus rules and applicable law;
- inspecting items and evaluating counterparties;
- using safe meeting, delivery, and payment practices; and
- resolving obligations they accept through a transaction.
Do not list illegal, stolen, counterfeit, dangerous, recalled, age-restricted, infringing, deceptive, or otherwise prohibited items or services. We may remove content, restrict features, suspend accounts, or cooperate with lawful investigations.
Payments may be processed by third-party providers. Payment authorization does not guarantee item quality, delivery, or user performance. Refunds, chargebacks, disputes, courier claims, and seller settlement may be subject to provider rules and additional instructions displayed during the transaction.
3. Agovia
Agovia provides information, talent discovery, concierge, research, education, travel, vehicle-related, and other support services described in the relevant product flow.
Quotes and estimates may depend on information supplied by users and third parties. Unless expressly guaranteed in writing, timing, availability, pricing, exchange rates, duties, taxes, travel conditions, admissions outcomes, vehicle availability, and third-party decisions may change.
You are responsible for verifying important information before relying on it or entering a transaction. Agovia does not provide legal, tax, immigration, investment, medical, or other regulated professional advice unless the service expressly states otherwise and is delivered by an appropriately qualified professional.
Additional terms, cancellation rules, refund conditions, or provider requirements shown at checkout become part of these Terms for that purchase.
4. Chacha Markets simulation
Chacha Markets is an educational and entertainment simulation. At launch:
- credits are provided free of charge;
- credits cannot be purchased;
- credits have no cash or monetary value;
- credits cannot be transferred, redeemed, withdrawn, or exchanged for money, property, prizes, or services; and
- no wager, deposit, payout, prize, or real-money gambling is offered.
Market questions, probabilities, forecasts, scores, rankings, and simulated outcomes are not financial, investment, trading, betting, or legal advice. Do not make financial or other important decisions based on the simulation.
We may adjust or reset simulated credits, markets, outcomes, rankings, or other simulation data to correct errors, test features, enforce rules, or maintain the integrity of the Service.
5. User content and conduct
“User Content” includes listings, profiles, ratings, reviews, messages, proposals, evidence, images, and other material submitted through the Services.
You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and use it as reasonably necessary to operate, secure, moderate, improve, and promote the relevant Service. This license ends when the content is deleted from active systems, except for lawful retention, backups, dispute evidence, and content shared with others who have not deleted it.
You must not:
- impersonate others or provide materially false information;
- harass, threaten, exploit, discriminate against, or endanger anyone;
- post unlawful, fraudulent, sexually exploitative, hateful, violent, or infringing content;
- exploit or abuse minors;
- manipulate ratings, markets, payments, or platform metrics;
- introduce malware or attempt unauthorized access;
- scrape, reverse engineer, overload, or disrupt the Services except where law expressly permits;
- evade account restrictions or security controls; or
- use the Services for money laundering, sanctions evasion, fraud, or other illegal activity.
We may review reports, remove content, limit functionality, preserve evidence, or suspend or terminate accounts. Users can report safety or content concerns at borderlessbrilliance@gmail.com.
6. Payments and third-party services
The Services may use Stripe, Flutterwave, MTN MoMo, and other providers. Their terms and privacy practices also apply to their services. We do not store full card numbers or mobile-money credentials when those details are collected directly by a payment provider.
You authorize applicable charges, taxes, fees, refunds, and adjustments disclosed during a transaction. Provider availability and payment methods vary by country. Never send payment outside an approved flow when the Service instructs you to use an in-app or hosted provider checkout.
7. Intellectual property
The Services—including software, designs, branding, text, and content created by us—are owned by us or our licensors and protected by applicable law. These Terms give you a limited, personal, non-exclusive, revocable right to use the Services for their intended purposes. They do not transfer ownership of our intellectual property.
8. Service availability and changes
We may modify, suspend, or discontinue features; perform maintenance; impose reasonable limits; or release beta functionality. We will use reasonable efforts to avoid unnecessary disruption but do not guarantee uninterrupted or error-free availability.
9. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
We do not guarantee user identity, user conduct, listing quality, academic or travel outcomes, third-party information, payment-provider performance, or simulated-market accuracy.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill arising from the Services.
Our aggregate liability for a claim will not exceed the greater of the amount you paid us for the specific Service giving rise to the claim during the six months before the event or US$100. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
11. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims arising from your unlawful use of the Services, your User Content, your transactions with other users, or your material violation of these Terms.
12. Suspension and termination
You may stop using the Services at any time and request account deletion through our Account Deletion page.
We may suspend or terminate access when reasonably necessary to protect users, comply with law, investigate misconduct, prevent fraud, address security risk, or enforce these Terms. Where appropriate, we will provide notice or an opportunity to appeal.
13. Disputes and applicable law
These Terms are governed by applicable laws of Ghana and, for Services or transactions operated through Agyeah Motors LLC in the United States, applicable United States federal and state law, without overriding mandatory consumer protections that apply where you live.
Before filing a formal claim, please contact borderlessbrilliance@gmail.com and allow 30 days for an informal resolution. Nothing here prevents either party from seeking urgent injunctive relief or using a government or consumer-protection process.
14. Changes to these Terms
We may update these Terms as the Services change. We will update the date above and provide additional notice when required. Continued use after an update takes effect means you accept the revised Terms.
